US Attorney Responds to Indian Lies & Exaggerations:
US vs Devyani Khobragade

There has been much misinformation and factual inaccuracy in the reporting on the charges against Devyani Khobragade.

It is important to correct these inaccuracies because they are misleading people and creating an inflammatory atmosphere on an unfounded basis. Although I am quite limited in my role as a prosecutor in what I can say, which in many ways constrains my ability here to explain the case to the extent I would like, I can nevertheless make sure the public record is clearer than it has been thus far.

First, Ms. Khobragade was charged based on conduct, as is alleged in the Complaint, that shows she clearly tried to evade U.S. law designed to protect from exploitation the domestic employees of diplomats and consular officers.

Not only did she try to evade the law, but as further alleged, she caused the victim and her spouse to attest to false documents and be a part of her scheme to lie to U.S. government officials. So it is alleged not merely that she sought to evade the law, but that she affirmatively created false documents and went ahead with lying to the U.S. government about what she was doing.

One wonders whether any government would not take action regarding false documents being submitted to it in order to bring immigrants into the country. One wonders even more pointedly whether any government would not take action regarding that alleged conduct where the purpose of the scheme was to unfairly treat a domestic worker in ways that violate the law.

And one wonders why there is so much outrage about the alleged treatment of the Indian national accused of perpetrating these acts, but precious little outrage about the alleged treatment of the Indian victim and her spouse?

Second, as the alleged conduct of Ms. Khobragade makes clear, there can be no plausible claim that this case was somehow unexpected or an injustice. Indeed, the law is clearly set forth on the State Department website. Further, there have been other public cases in the United States involving other countries, and some involving India, where the mistreatment of domestic workers by diplomats or consular officers was charged criminally, and there have been civil suits as well. In fact, the Indian government itself has been aware of this legal issue, and that its diplomats and consular officers were at risk of violating the law.

The question then may be asked: Is it for U.S. prosecutors to look the other way, ignore the law and the civil rights of victims (again, here an Indian national), or is it the responsibility of the diplomats and consular officers and their government to make sure the law is observed?

Third, Ms. Khobragade, the Deputy General Consul for Political, Economic, Commercial and Women’s Affairs, is alleged to have treated this victim illegally in numerous ways by paying her far below minimum wage, despite her child care responsibilities and many household duties, such that it was not a legal wage. The victim is also alleged to have worked far more than the 40 hours per week she was contracted to work, and which exceeded the maximum hour limit set forth in the visa application. Ms. Khobragade, as the Complaint charges, created a second contract that was not to be revealed to the U.S. government, that changed the amount to be paid to far below minimum wage, deleted the required language protecting the victim from other forms of exploitation and abuse, and also deleted language that stated that Ms. Khobragade agreed to “abide by all Federal, state, and local laws in the U.S.”

As the Complaint states, these are only “in part” the facts, and there are other facts regarding the treatment of the victim – that were not consistent with the law or the representations made by Ms. Khobragade -- that caused this Office and the State Department, to take legal action.

Fourth, as to Ms. Khobragade’s arrest by State Department agents, this is a prosecutor’s office in charge of prosecution, not the arrest or custody, of the defendant, and therefore those questions may be better referred to other agencies. I will address these issues based on the facts as I understand them.

Ms. Khobragade was accorded courtesies well beyond what other defendants, most of whom are American citizens, are accorded.

She was not, as has been incorrectly reported, arrested in front of her children. The agents arrested her in the most discreet way possible, and unlike most defendants, she was not then handcuffed or restrained. In fact, the arresting officers did not even seize her phone as they normally would have. Instead, they offered her the opportunity to make numerous calls to arrange personal matters and contact whomever she needed, including allowing her to arrange for child care. This lasted approximately two hours. Because it was cold outside, the agents let her make those calls from their car and even brought her coffee and offered to get her food. It is true that she was fully searched by a female Deputy Marshal -- in a private setting -- when she was brought into the U.S. Marshals’ custody, but this is standard practice for every defendant, rich or poor, American or not, in order to make sure that no prisoner keeps anything on his person that could harm anyone, including himself.

This is in the interests of everyone’s safety.

Fifth, as has been reported, the victim’s family has been brought to the United States.

As also has been reported, legal process was started in India against the victim, attempting to silence her, and attempts were made to compel her to return to India. Further, the Victim’s family reportedly was confronted in numerous ways regarding this case.

Speculation about why the family was brought here has been rampant and incorrect. Some focus should perhaps be put on why it was necessary to evacuate the family and what actions were taken in India vis-à-vis them. This Office and the Justice Department are compelled to make sure that victims, witnesses and their families are safe and secure while cases are pending.

Finally, this Office’s sole motivation in this case, as in all cases, is to uphold the rule of law, protect victims, and hold accountable anyone who breaks the law – no matter what their societal status and no matter how powerful, rich or connected they are.

The FBI needs to investigate the criminal activity of the agents of the Indian intelligence agency, RAW, in its consulates in the US, Canada and UK.

My goodness, I wonder what torture the Indian political psyche must be enduring right now. First, their world was rocked when a government official was actually arrested for a crime. Now they see that the prosecutor has tanned skin, just like they do. Their foreign tongues don't have to fumble through the pronunciation of his name. It rolls off their lips with strange familiarity. Welcome to the civilized world, India. No one is above the law, and even minorities can reach positions of power and respect through honesty, integrity and hard work. Also, don't forget the 'SINGH' in this man's name. I know you wouldn't leave that out on purpose, my dear sweet desi counterparts.

Preet ji, we're all very proud of you. Please continue to do the right thing and do not bend under the pressure from the Indian government. On a side note, the maid's lawyer said that a New York City gurdwara helped her (Note to the 'laee laag' jathedars in Punjab - this is Sikhi!) The Indian politicians and their lap-dog media has been jumping wildly all over this story with fabrications and lies. The common thread coming out of the wailing and breast-beating is "Hamaari izzat ka sawaal hai". Other than calls for nuking the USA, the hysterical crowd is demanding the blood of Americans. Some are calling for the boycott of America while BJP leader Yashwant Sinha has demanded the arrest of all gay US diplomats. The Indian Government and its handmaiden judiciary has been fully exposed for issuing a warrant of arrest for blackmailing the hapless domestic worker in order to prevent her from speaking the truth. CNN has done an in-depth story on this and blamed India for suppressing the main issue of exploitation of domestic worker Sunita Richards and the actions of its senior diplomat in the visa fraud case. Mary Harf, the state department official, has made it clear that there will be no interference in the enforcement of the laws of the United States. While Indian leaders of all stripes appear outraged at the "barbaric and insulting treatment" of their consular officer, they continue to be completely blind and deaf to the struggle of Bhai Gurbakash Singh and hundreds of Sikh prisoners, most of whom are languishing in Indian prisons for decades on trumped charges under draconian laws which would shame even the most barbaric governments.

Stand tall, Preet and the Obama Administration. The Indian blood-sucking corrupt classes need to be taught a lesson in the dignity of labor and respect for lawful conduct. The Indian consulates are dens of corruption. They are an extension of India for suppressing the voices of minorities. Indians have been killing minorities with impunity. The people are at the mercy of the politicians and these bureaucrats who create and impose their own rules on the masses. Consular, embassy and high commission officers are demeaning and demand money under the table even for visas and passport services by putting roadblocks in every application. The list of their illegal and immoral behavior is too long.

Lets see if I can make India see the logic in this scenario! I hire a software engineer from Bangalore and submit the H1 paperwork showing salary of $80k per year. Then I tell him that his actual pay would be $40k and no overtime or PTO accrued. He will be working 60 hours per week minimum. In return, he should be glad because I am taking him to USA! Do you see anything wrong with this picture? Stop making fools of yourselves in front of the whole world!

The Indians are backing down now as the U.S. stated they will not drop the charges. As well, even though they have tried giving Khobragade full diplomatic immunity by transferring her to the UN post, the US said that position can't interfere with existing charges. So India is backing down. Apparently they are turning on Khobragade for some scam involving a flat back in India too. She is used to scamming, it seems. The Indians would never sever US ties and stop getting aid from the US over some medium ranking diplomat caught in the "act".

Thanks, Preet ji, for standing up to the corrupt system of India. This incident exposes India's dishonest nexus between media, judiciary, legislature and police at the international level. It proves that Indian media is good at fabricating lies by barking loud, and can provoke the general public by creating an inflammatory environment. They have done similar exercises of covering facts many times over in the past. I guess they did not see this one coming ... that a US prosecutor like Preet Singh will stand up to their lies.

The Banana Republic of india being exposed all over the world! No sympathy for the Indian consulate staff as they knew they were trying to mess with US law. India expects US legal system to close it's eyes and ears and look other way now. India needs to know it has to keep its dirty laundry inside the four walls of its compound. It went out and now the US legal system has to take appropriate action. It's USA! These things have happened before in the embassies and consulates of the banana republic of india, including pressing of charges against it's staff by it's own staff. So what is the different now? Seems fishy, the desis are trying to hide something and do not want actual truth exposed during trial. I say to the US attorney, go for it. Let's see it all, what's hiding behind all of this. Why this urgency on the part of India to get their criminal transferred to the UN or get her back to India? Something really fishy. The lemmings who support the banana republic, come out of your shell, otherwise it will be too late before your country becomes a total shit place.

Manmohan Singh, India's PM, remarked "deplorable" the current Cobragate spat. He has proved himself to be a puppet, as he is often referred to in the Indian media. And he is known to be the most honest politician? Even though he knows he is not going to be a PM for another term, he still does not have the courage to say and do the right thing. He should have investigated the matter before remarking! But then, he denies the holocaust of innocent Sikhs in 1984 too! It is illegal to deny the Jewish holocaust, especially in all civilized and law-abiding countries. Sikhs need someone like Preet Bharara. He is also my choice to be named the Chic Sikh of the year 2013. My second choice would be Sardar Waris Singh Ahluwalia, although there are so many others who also deserve this title. Preet has clarified the Cobragate situation. Now, let's see if the Indian politicians can back down, in view of the facts, although I don't expect that they will soon as it is a common practice in all the Indian diplomatic missions to underpay their staff illegally and that this case can have a domino effect!
